Shipping and Return Policy

Governing Law: This Policy is established by Nanddiz LLC, a New Mexico Limited Liability Company. By placing an order or listing products on nanddiz.com, you expressly agree to be bound by the terms set forth herein, specifically as they relate to transactions governed by the laws of New Mexico and, where applicable, California.
1. Definitions
2. Shipping Policy (All Buyers)
2.1 Order Processing & Verification
All orders—whether placed by Customers, Wholesalers, or through Vendor storefronts—are subject to a 5‑business‑day verification period. We reserve the right to cancel any order or transaction suspected of fraud, payment discrepancies, or violation of our terms.
Processing Time: 3–10 business days (Monday–Friday, excluding federal and New Mexico state holidays).
No Expedited Processing: Rush processing is not available.
2.2 Shipping Address & Delivery
Carrier Selection: Nanddiz LLC selects carriers (USPS, FedEx, UPS) and may change carriers without notice.
Incorrect Addresses: Customers and Wholesalers are solely responsible for providing accurate shipping information. Returned packages due to address error incur a $15.00 address correction fee plus re‑shipping costs. Orders abandoned for 14 calendar days are forfeited without refund.
Lost / Stolen Packages: Risk of loss passes to the buyer upon carrier “Delivered” status. Nanddiz LLC is not liable for lost or stolen packages after delivery confirmation.
3. Return & Refund Policy
3.1 Strict “All Sales Final” Baseline
Unless a specific exception applies, all sales are final. No returns, exchanges, or refunds are permitted for change of mind, sizing issues, buyer’s remorse, or subjective dissatisfaction.
3.2 Limited Exceptions – Defective or Incorrect Items
Returns are considered only under the following narrow circumstances:
Manufacturing Defect – a demonstrable flaw present at delivery that materially affects functionality.
Incorrect Item Shipped – the item received does not match the item on the packing slip.
Exclusions: Sizing, minor color/design variations, wear and tear, misuse, and damage after delivery are not eligible.
3.3 Return Process (All Buyers)
Deadline: Contact support@nanddiz.com within 7 calendar days of delivery for a Return Merchandise Authorization (RMA). Requests after 7 days are denied.
Condition: Items must be unused, unwashed, with original tags and packaging. Unauthorized returns are discarded at buyer’s expense.
Restocking Fee: A 25% restocking fee applies to all approved returns.
Shipping Costs: Original shipping is non‑refundable; buyer pays return shipping unless the error was solely Nanddiz LLC’s fault (incorrect item shipped).
3.4 Refunds & Chargebacks
Approved refunds are issued to the original payment method within 14–21 business days after inspection. We reserve the right to issue store credit instead. Initiating a chargeback forfeits any right to a refund under this Policy.
4. Wholesale Purchases (B2B)
Wholesalers are business entities that have been approved for wholesale pricing and purchase products for resale or commercial use. The following terms apply in addition to the general provisions above.
4.1 Eligibility & Account
Wholesale accounts are granted at the sole discretion of Nanddiz LLC. We reserve the right to revoke wholesale status at any time.
4.2 Minimum Order Quantities & No Returns
All wholesale orders are subject to minimum quantity requirements stated in the wholesale agreement or product listing.
Wholesale orders are strictly non‑returnable. No exceptions for defects or incorrect items will be granted. Wholesalers assume all risk upon shipment.
4.3 Pricing & Payment
Wholesale pricing is confidential and subject to change without notice.
Payment terms are net 15 days from invoice date unless otherwise agreed in writing. Late payments incur a 2% monthly interest charge.
4.4 Liability
Nanddiz LLC’s liability for wholesale orders is limited to the invoice value of the affected goods. Under no circumstances shall we be liable for lost profits or consequential damages.
5. Third‑Party Vendors (Sellers on nanddiz.com)
Nanddiz LLC operates a platform that allows independent Vendors to list and sell products. The following terms govern Vendor transactions.
5.1 Vendor Responsibility
Each Vendor is an independent seller and is solely responsible for:
Product quality, safety, and compliance with all applicable laws (including labeling, warranty, and consumer protection laws).
Fulfillment, shipping, returns, and customer service for their own products.
Compliance with the New Mexico Unfair Practices Act and, for sales to California residents, the Song‑Beverly Consumer Warranty Act.
5.2 Platform Role
Nanddiz LLC provides the platform, payment processing, and order aggregation but does not act as the seller for Vendor products. Our liability for Vendor transactions is limited to the facilitation services. We are not a party to the sale between the Vendor and the Customer.
5.3 Vendor Returns & Refunds
Each Vendor must maintain a return policy that meets or exceeds the strictness of this Policy. Vendor policies must be clearly displayed on their storefront.
Dispute Resolution: Customers with issues regarding Vendor products must first contact the Vendor directly. Nanddiz LLC may, at its discretion, mediate disputes but is not obligated to issue refunds for Vendor products.
5.4 Vendor Compliance with California Law
Vendors selling to California residents must:
Comply with the Song‑Beverly Act’s implied warranty provisions.
Provide a clear process for returns of defective goods that does not impose unreasonable barriers.
Comply with the California Privacy Rights Act (CPRA) regarding customer data they collect directly.
Failure to comply may result in removal from the platform.
5.5 Vendor Indemnification
Each Vendor agrees to indemnify, defend, and hold harmless Nanddiz LLC from any claims, damages, or liabilities arising out of their products, listings, or failure to comply with applicable laws.
6. New Mexico Consumer Compliance
Nanddiz LLC operates in compliance with the New Mexico Unfair Practices Act (NMSA 1978, § 57-12-1 et seq.) .
6.1 Prohibited Practices
We strictly prohibit:
Representing goods as original or new if they are deteriorated, altered, or used.
Failing to deliver the quality or quantity of goods contracted for.
Using ambiguity or omitting a material fact that deceives or tends to deceive.
6.2 Penalties
Knowing violations constitute willful acts. The New Mexico Attorney General may impose civil penalties of up to $10,000 per violation, plus costs of investigation.
6.3 Limitation of Liability
To the fullest extent permitted by New Mexico law, Nanddiz LLC disclaims all implied warranties. Our total liability shall not exceed the amount paid for the specific product at issue.
7. California‑Specific Provisions
If you are a resident of California or your transaction is subject to California law, the following provisions apply in addition to the terms above. In the event of a conflict between this section and other sections of this Policy, this California section shall control for California residents.
7.1 Song‑Beverly Consumer Warranty Act (California Civil Code § 1790 et seq.)
California residents are entitled to the implied warranties of merchantability and fitness for a particular purpose for the duration of the applicable warranty period. If a product is defective and Nanddiz LLC (or the Vendor, for Vendor products) is unable to repair or replace after a reasonable number of attempts, California residents may be entitled to a refund of the purchase price, including taxes and fees, less a reasonable usage fee.
For Vendor products: The Vendor is the warrantor. Nanddiz LLC will assist with facilitating warranty claims but is not liable for the Vendor’s failure to perform.
7.2 California Privacy Rights Act (CPRA) Compliance
If you are a California resident, you have the right to:
Know what personal information we collect.
Request deletion of your personal information (subject to exceptions).
Opt out of the “sharing” of your data for cross‑context behavioral advertising (via “Do Not Sell or Share My Personal Information” link or Global Privacy Control).
To exercise these rights, email privacy@nanddiz.com with “California Privacy Request” in the subject line. We will verify your identity before responding.
7.3 Notice of Financial Incentive
If Nanddiz LLC operates a loyalty or rewards program, material terms and opt‑in/out instructions will be provided as required by California law.
8. International Orders
This section applies to International Customers (any shipment with a destination outside the fifty United States and the District of Columbia). By placing an international order, you acknowledge and agree to the following strict terms.
8.1 Shipping & Delivery
Eligibility: Nanddiz LLC ships to select international destinations as indicated at checkout. We reserve the right to refuse or cancel any international order at our sole discretion.
Processing & Transit: International orders require 5–15 business days for processing, plus additional transit time depending on destination and customs clearance. No delivery date guarantees are provided.
Carrier & Tracking: We use third‑party international carriers. Tracking may be limited or unavailable once the package leaves the United States.
8.2 Customs, Duties, Taxes & Fees
Customer Responsibility: International Customers are solely responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by the destination country. These fees are not included in the purchase price or shipping cost paid to Nanddiz LLC.
Non‑Payment: If a shipment is refused, abandoned, or returned due to non‑payment of duties/taxes, the Customer forfeits the order. No refunds will be issued for the product or shipping costs.
Customs Inspection: We are not responsible for delays caused by customs inspections, holds, or seizures. Products seized or destroyed by customs authorities are not eligible for refund.
8.3 Export Compliance
All products sold are subject to U.S. export control laws. International Customers agree to comply with all applicable export restrictions and warrant that they are not located in a country subject to U.S. sanctions or prohibited from receiving U.S. exports.
8.4 Returns & Refunds – International Orders
Strict No‑Return Policy: International orders are final and non‑returnable. No returns, exchanges, or refunds will be accepted for any reason, including manufacturing defects or incorrect items, unless required by applicable law in the destination country that cannot be waived.
Exceptional Circumstances: In the rare event that Nanddiz LLC, at its sole discretion, authorizes a return, the International Customer shall bear:
All return shipping costs (including any customs fees, duties, or taxes incurred during return transit);
A 35% restocking fee (increased from 25% to reflect international handling);
Any applicable currency conversion or bank fees.
Refund Processing: If a refund is approved, it will be issued in the original payment currency. Nanddiz LLC is not responsible for exchange rate fluctuations or foreign transaction fees imposed by the Customer’s financial institution.
8.5 Limitation of Liability for International Orders
To the maximum extent permitted by law, Nanddiz LLC disclaims all liability for:
Delays, loss, or damage occurring after the package is handed to the international carrier;
Customs‑related issues, including seizure, destruction, or additional charges;
Non‑delivery due to inaccurate address, refusal to accept the package, or failure to pay import fees.
Our total liability for any international order shall not exceed the amount paid for the product, excluding shipping and taxes.
9. Governing Law & Jurisdiction
9.1 General Jurisdiction
This Policy and any disputes arising hereunder shall be governed by the laws of the State of New Mexico, without regard to conflict of law principles.
9.2 Venue
Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico.
9.3 California Resident Exception
For California residents, nothing in this section prevents you from asserting your rights under the Song‑Beverly Act in the courts of California, though the interpretation of this contract shall still be governed by the substantive laws of New Mexico where not preempted by California public policy.
9.4 International Disputes
International Customers agree to submit to the exclusive jurisdiction of the courts of Bernalillo County, New Mexico, for any dispute arising from this Policy. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
10. Modification of Policy
Nanddiz LLC reserves the right to modify this Shipping and Return Policy at any time without prior individual notice. Changes are effective immediately upon posting to nanddiz.com.
